WEST VIRGINIA MEDICAID PROGRAM

STATE PLAN AMENDMENT 22-0012

REGARDING

PRESCRIPTION REFILLS



Pursuant to 42 U.S.C. §1396a(a)(13)(1997) and 42 C.F.R. §447.205, the Department of Health and Human Resources (“Department”), Bureau for Medical Services (“BMS”) provides notice of the filing of a state plan amendment (SPA), identified as SPA 22-0012, regarding prescription refills. 

This SPA allows for the dispensing of 90 day prescription refills. 

This SPA will be effective April 1, 2022, pending CMS approval. The change would be cost neutral for Fiscal Year 2022 but would decrease costs in Fiscal Year 2023 by $9,686,300.

The SPA and this notice will be available for public inspection between Wednesday March 30, 2022 and Friday April 29, 2022.
