State Plan Amendment (SPA) 21-004 regarding COVID Vaccines is now available for public comment until April 2, 2021.


Pursuant to 42 U.S.C. §1396a(a)(13)(1997) and 42 C.F.R. §447.205, the Department of Health and Human Resources (“Department”), Bureau for Medical Services (“BMS”) provides notice of the filing of a state plan amendment (SPA), identified as SPA 21-004, regarding the COVID Vaccine Services under West Virginia Medicaid.
SPA 21-004:  This SPA seeks to update physician services reimbursement in Attachment 4.19-B, page 3aa, in order to add coverage for vaccines for COVID-19 under 42 CFR § 410.20. Additionally, this proposed SPA seeks to remove out-of-date pages (Attachment 4.19-B, pages 24 and 25) related to increased primary care service payments under 42 CFR 447.405, 447.410, and 447.415, which included temporary increases for vaccine codes and other primary care services
This SPA will be effective March 1, 2021, pending CMS approval.  The impact to the fiscal year are unknown at this time. The SPA and this notice will be available for public inspection in each county office of the Department of Health and Human Resources during normal business hours, 8:30 a.m. to 4:30 p.m., beginning Wednesday, March 3, 2021, through Friday, April 2, 2021 and on the web at:, then click “Public Notices” on the top toolbar.
